Asbestos & the Law

With regard to asbestos in a workplace, owners of commercial buildings have certain legislative requirements under the Health and Safety At Work (Asbestos) Regulations 2016. In short, the legislation states that the owner of a commercial building likely to contain asbestos must either:

  • Produce proof that their building is free of all asbestos, or
  • Produce an Asbestos Management Plan that identifies all asbestos in the building, manages any risk posed by that asbestos, and monitors any work carried out where asbestos contamination could result.

Asbestos Management Plans

The Health and Safety at Work (Asbestos) Regulations 2016 place a duty on businesses to have an Asbestos Management Plan in place for workplaces where asbestos is likely to be found.

This Management Plan must set out where any identified asbestos or asbestos-containing material is present, and how it will be managed to ensure occupants of the building, and visitors to it, are safe.
